35-year old Craig Guild from Dundee in Scotland has filed a claim against the Scottish Prison Service, asking for £2500 in compensation for being made to share a cell with a smoker during his four and half jail term for theft and breach of bail conditions.
He hopes to be awarded this money because prison officials were aware of the fact that he was a non-smoker but still made him share an overcrowded cell with a smoker, according to him having two people in a single cell is a breach of human right let alone being forced to contend with a smoker when clearly you are not one.
It is believed that if successful Mr Guild who is the first to file such a claim could set a precedent for similar claims from both former and serving prisoners across Scotland.
